Ontario Regulation 153 requires owners of industrial and commercial properties to file a Record of Site Condition with the Ministry of Environment if they intend to rezone the property to a more sensitive use. For example, converting a property from industrial to residential use. A Record of Site Condition requires a Phase I Assessment, a Phase II Assessment, and potentially a Phase III Assessment if contamination is discovered. The property owner must demonstrate either compliance with applicable regulatory standards or apply to the Ministry of Environment for a Risk Assessment of the property.
Owners of properties which cannot practicably meet established regulatory standards may apply for site specific standards through the development of a Risk Assessment. This requires extensive scientific studies to determine the risks associated with exposure to site specific contaminants for people, plants, wild life, and the natural environment.
